These Terms & Conditions apply to purchases, sales and use of the BM Collectibles website at bmcollectibles.co.uk.
BM Collectibles ("we", "us", "our") is an online trading card business specialising in football and sports trading cards.
By using our website, purchasing products from us, or using our Sale or Return service, you agree to these Terms & Conditions.
1. About BM Collectibles
BM Collectibles operates an online business selling football and sports trading cards, collections, sealed products and related items.
We may also purchase cards directly from customers and offer a Sale or Return service where customers retain physical possession of their cards while BM Collectibles markets and sells them on their behalf.
2. Ordering from us
When you place an order through our website, you are making an offer to purchase the products in your order.
You should receive an acknowledgement confirming that we have received your order.
An order is not necessarily accepted simply because you have received an order acknowledgement.
We reserve the right to refuse or cancel an order where there is a genuine reason to do so, including where:
A product is incorrectly priced.
A product is incorrectly described.
A product is no longer available.
We suspect fraudulent or unauthorised activity.
There has been a technical or website error.
We are unable to fulfil the order.
If we cancel an order after payment has been taken, we will provide a full refund for the cancelled order.
We will not deliberately cancel an accepted order simply because the market value of a collectible has increased after the order was placed.
3. Product descriptions and photographs
We make reasonable efforts to ensure that product descriptions, photographs and other information on our website are accurate.
Trading cards are collectible items and may vary in appearance due to photography, lighting, screen settings and manufacturing differences.
Where a specific card is pictured, the photograph will generally represent the actual card being sold unless the listing clearly states otherwise.

Player
Club
Card manufacturer
Card set
Card number
Serial number
Parallel or variation
Autograph
Relic or memorabilia
Grading
Card condition
We will make reasonable efforts to ensure this information is accurate.
4. Card condition
Trading cards are collectible items and their condition can vary.
Unless specifically stated otherwise, cards are sold as ungraded.
We will make reasonable efforts to accurately describe the condition of cards where relevant.
Minor manufacturing imperfections may be present, including:
These do not necessarily mean that a card is defective.
Where a card has been professionally graded, the grading company and grade will be stated in the listing where applicable.
We do not guarantee that an ungraded card will achieve a particular grade if subsequently submitted to a grading company.
5. Pricing
All prices displayed on our website are in Pounds Sterling (£) unless otherwise stated.
We make reasonable efforts to ensure that prices are accurate.
If a genuine pricing or technical error results in a product being advertised at an obviously incorrect price, we reserve the right to cancel the order and refund any payment made.
6. Payment
Payment must be made using the payment methods available through our website at the time of purchase.
Payment is normally required before an order is dispatched.
Payment information may be processed by third-party payment providers.
We do not intentionally store your complete payment card details.
You must only use a payment method that you are authorised to use.
7. Delivery
We will dispatch orders to the delivery address provided when the order is placed.
You are responsible for ensuring that the delivery information provided is accurate.
Delivery times displayed on the website are estimates unless specifically stated otherwise.
Once your order has been dispatched, delivery is carried out by the relevant postal or delivery service.
If an order is delayed, lost or damaged during delivery, please contact us as soon as reasonably possible so that we can investigate the issue and take appropriate action.
We will comply with our obligations under UK consumer law in relation to delivery.
8. Risk and ownership
For consumers, risk in goods will normally pass to you when you, or a person identified by you, takes physical possession of the goods.
Ownership of the goods will pass to you once we have received full payment and the goods have been delivered to you, unless applicable law requires otherwise.
9. Your statutory consumer rights
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
Under UK consumer law, goods supplied to consumers must generally be:
If a product is faulty, damaged, materially misdescribed or otherwise does not meet the requirements of applicable consumer law, you may have rights to a repair, replacement, price reduction or refund depending on the circumstances.
These rights are separate from any voluntary returns policy we may offer.
10. Your right to cancel an online order
If you are a consumer purchasing goods from us online, you may generally have the right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Unless an applicable legal exception applies, you normally have 14 days from the day after you receive the goods to tell us that you wish to cancel.
You then generally have a further 14 days to return the goods.
Where you exercise your statutory cancellation right, we will refund the purchase price and the standard delivery charge paid at the time of purchase, subject to applicable law.
We may withhold reimbursement until we have received the goods back or you have provided evidence that you have returned them, whichever occurs first.
You may be responsible for the direct cost of returning goods where the law permits this.
11. Returns and refunds
Where you are legally entitled to a refund, we will process the refund in accordance with applicable UK consumer law.
Refunds will normally be made using the original payment method unless otherwise agreed or permitted by law.
Where appropriate, refunds will be processed without undue delay and within the applicable legal time limits.
Where applicable, we may not refund additional delivery costs resulting from your choice of a more expensive delivery option.
12. Condition of returned cards
Returned trading cards should be returned in the same condition in which they were received, subject to the normal handling required to inspect the goods.
You should package cards carefully to prevent damage during return.
If goods have been handled beyond what is reasonably necessary to establish their nature, characteristics and functioning, you may be responsible for any resulting reduction in value where permitted by law.
This does not affect your statutory rights where goods are faulty, damaged or incorrectly described.
13. Damaged goods
If your order arrives damaged, please contact us as soon as possible.
Where possible, please provide photographs of:
This helps us investigate the issue with the delivery provider.
You retain your statutory consumer rights regardless of whether you are able to provide photographs.
14. Incorrect or missing items
If you receive an incorrect item or an item is missing from your order, please contact us as soon as possible.
We will investigate the issue and, where appropriate, arrange a replacement, refund or other suitable remedy.
15. Sale or Return service
BM Collectibles may offer a Sale or Return service.
Under this service, customers can provide cards for BM Collectibles to market and sell on their behalf while the customer retains physical possession of the cards until they are sold.
The customer does not normally need to send the cards to BM Collectibles before they are sold.
When a card sells, BM Collectibles will provide the customer with a postage label or other delivery instructions so that the sold card can be posted to the required destination.
A separate Sale or Return Agreement may also be provided to the customer containing the specific commercial terms applicable to their arrangement.
16. Ownership of Sale or Return cards
The customer remains the legal owner of their cards until the relevant card is sold and the transaction is completed, unless otherwise agreed in writing.
BM Collectibles does not take ownership of a card simply by agreeing to list it for Sale or Return.
By submitting a card for Sale or Return, the customer confirms that:
They are the legal owner of the card or have authority from the legal owner to sell it.
The card is not stolen or unlawfully obtained.
Information provided about the card is accurate to the best of their knowledge.
Significant damage, alterations or defects have been disclosed.
The card is authentic and has not been deliberately altered or tampered with.
17. Listing Sale or Return cards
BM Collectibles may photograph, describe, price and advertise Sale or Return cards.
We may use photographs and descriptions of the cards for the purpose of marketing and selling them through:
We may make reasonable adjustments to descriptions, photographs or listing formats where necessary to market the card effectively.
The agreed selling price or pricing arrangement will be confirmed with the customer where applicable.
18. Sale or Return commission
BM Collectibles may retain an agreed commission or percentage of the final sale price of a Sale or Return card.
The applicable commission and payment arrangement will be set out in the customer's Sale or Return Agreement.
Unless otherwise agreed, BM Collectibles will not change the agreed commission structure without informing the customer.
19. When a Sale or Return card sells
When a card is sold, BM Collectibles will notify the customer and provide the necessary postage instructions or postage label.
The customer must dispatch the card within the timeframe specified in their Sale or Return Agreement or the instructions provided by BM Collectibles.
The customer is responsible for packaging the card securely and appropriately before posting it.
Cards should be protected against bending, moisture, impact and other reasonably foreseeable damage during postage.
The customer should retain proof of postage.
20. Failure to send a sold card
Once a Sale or Return card has been sold through BM Collectibles, the customer must not sell, trade, give away or otherwise dispose of that card elsewhere.
If the customer fails to dispatch a sold card within the required timeframe, BM Collectibles may contact them to request an update.
Continued failure to dispatch a sold card may result in:
The sale being cancelled;
The Sale or Return arrangement being suspended;
The customer's ability to use the service being restricted; and/or
Further action being taken where appropriate.
21. Condition of Sale or Return cards
Because the customer retains physical possession of Sale or Return cards before they sell, the customer is responsible for keeping the cards safe and in substantially the same condition as when they were listed.
The customer must not:
Damage the card;
Alter the card;
Remove an autograph, sticker, patch or other feature;
Replace the card with another card;
Attempt to repair or modify the card without informing BM Collectibles; or
Otherwise materially change the card.
If the condition of a card materially changes after it has been listed, the customer must inform BM Collectibles.
22. Loss or damage before posting
While a Sale or Return card remains in the customer's physical possession, the customer is responsible for keeping it safe.
This includes taking reasonable precautions against:
If a card is lost or damaged while in the customer's possession before it is handed to the postal service, the customer must notify BM Collectibles immediately.
23. Postage of Sale or Return cards
Where BM Collectibles provides a postage label, the customer must use the label and postage method provided unless otherwise agreed.
The customer must package the card securely.
The customer should obtain and retain proof of postage until BM Collectibles confirms receipt where applicable.
If a card is lost or damaged during postage, BM Collectibles may require evidence of postage and may work with the relevant postal provider to investigate the matter.
24. Buyer cancellations and returns relating to Sale or Return cards
If a buyer has a legal right to cancel their purchase or return a Sale or Return card under applicable UK consumer law, BM Collectibles may need to accept and process that return.
Where a return relates to a Sale or Return card, BM Collectibles will contact the card owner where their involvement is required.
Nothing in these Terms & Conditions removes or limits a consumer buyer's statutory rights.
Where appropriate, a returned card may be returned to the original card owner rather than being relisted for sale.
25. Unsold Sale or Return cards
The customer remains the owner of any cards that do not sell.
The customer may request that an unsold card is removed from sale, subject to any minimum listing period or other arrangements agreed in the applicable Sale or Return Agreement.
Once removed from sale, BM Collectibles will provide instructions for the return or collection of the card where applicable.
A card cannot be withdrawn from sale after it has already been purchased by a buyer unless the transaction is cancelled in accordance with applicable law and these Terms & Conditions.
26. Ending a Sale or Return arrangement
Either the customer or BM Collectibles may end a Sale or Return arrangement in accordance with the applicable Sale or Return Agreement.
If the customer asks us to remove a card that has not sold, we will make reasonable efforts to remove the listing.
Cards that have already been sold cannot simply be withdrawn from the transaction.
27. Payment to Sale or Return customers
Once a Sale or Return card has been successfully sold, the applicable payment timeframe will be set out in the customer's Sale or Return Agreement.
Payment may be made after:
The buyer has completed payment;
The card has been received and checked where applicable;
Any applicable cancellation or return period has been accounted for; and
Any agreed BM Collectibles commission or fees have been deducted.
The exact payment process and timeframe will be confirmed in the applicable Sale or Return Agreement.
28. Authenticity and counterfeit cards
BM Collectibles takes the authenticity of trading cards seriously.
We do not knowingly sell counterfeit or unauthorised products.
If we reasonably believe that a card supplied through our Sale or Return service is counterfeit, altered, stolen or otherwise fraudulent, we may suspend the listing and investigate the matter.
If a card is found to be counterfeit or deliberately misrepresented, the Sale or Return arrangement may be terminated immediately.
We may also take any further action available to us under applicable law.
29. Buying cards directly from customers
From time to time, BM Collectibles may purchase trading cards or collections directly from members of the public.
Any offer made by BM Collectibles is subject to the information supplied about the cards being accurate and the cards being authentic and in the condition represented.
We reserve the right to refuse a purchase where we reasonably believe that cards:
Are counterfeit;
Have been altered or tampered with;
Have been materially misrepresented;
Are not owned by the person offering them for sale; or
Are otherwise unsuitable for purchase.
Any purchase price agreed will be confirmed separately.
30. Website errors
We make reasonable efforts to keep information on our website accurate.
However, errors may occasionally occur, including errors relating to:
Product descriptions;
Prices;
Availability;
Images;
Serial numbers; and
Product specifications.
If we identify a genuine error before an order has been accepted or fulfilled, we may contact you to explain the error and, where appropriate, offer you the option to proceed at the correct price or cancel the order.
31. Intellectual property
The content of the BM Collectibles website, including text, logos, graphics, photographs, branding and other original content, belongs to BM Collectibles or the relevant rights holder.
You must not reproduce, copy, distribute or commercially exploit our original website content without our written permission.
Product names, manufacturer names, football club names, player names and other third-party intellectual property remain the property of their respective owners.
32. Website availability
We aim to keep our website available and operating properly.
However, we do not guarantee that the website will always be available, uninterrupted or free from errors.
We may temporarily suspend or restrict access to the website for maintenance, updates, security reasons or other operational purposes.
33. Limitation of liability
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
This includes liability for:
Death or personal injury caused by negligence;
Fraud or fraudulent misrepresentation;
Breach of your statutory consumer rights; or
Any other liability that cannot legally be excluded or limited.
Subject to the above, we will not be responsible for losses that are not reasonably foreseeable or that arise outside the scope of our reasonable control.
Nothing in these Terms & Conditions affects your legal rights as a consumer.
34. Events outside our reasonable control
We will not be responsible for delays or failures caused by circumstances outside our reasonable control.
This may include:
Postal or courier disruption;
Natural disasters;
Severe weather;
Government restrictions;
Power or internet failures;
Cybersecurity incidents;
Strikes or industrial action; or
Other circumstances beyond our reasonable control.
Where such an event occurs, we will take reasonable steps to minimise its impact and keep affected customers informed where appropriate.
35. Privacy
Our Privacy Policy explains how we collect, use and protect personal information.
By using our website, you acknowledge that your personal information may be processed in accordance with our Privacy Policy.
36. Children's privacy
Our website is not specifically directed at children.
